1. Acceptance of Terms

By installing, accessing, or using the Sirvez Chrome extension and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Sirvez.

2. Description of Service

Sirvez provides a Chrome extension that enables users to:

• Record browser tabs and desktop screens
• Edit recordings with pan/zoom and annotation tools
• Add webcam overlays and cursor highlighting to recordings
• Store recordings locally or upload them to Sirvez Media Center
• Manage and share recordings through the Media Center

3. Eligibility

You must be at least 13 years old to use Sirvez. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using Sirvez on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. User Responsibilities

4.1 Recording Consent

You are solely responsible for:

• Obtaining all necessary consents before recording any person's image, voice, or likeness
• Complying with all applicable laws regarding recording, including wiretapping and privacy laws
• Ensuring you have the right to record and share any content captured through the Service
• Understanding that recording laws vary by jurisdiction and obtaining appropriate legal advice

4.2 Acceptable Use

You agree NOT to use Sirvez to:

• Record or share content that violates any law or regulation
• Infringe upon intellectual property rights of others
• Record confidential, proprietary, or sensitive information without authorization
• Harass, abuse, threaten, or intimidate others
• Upload malicious code, viruses, or harmful content
• Circumvent security features or access restrictions
• Engage in any illegal or unauthorized activity

4.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Content Ownership and License

5.1 Your Content

You retain all ownership rights to recordings and content you create using Sirvez ("Your Content"). However, by uploading content to Sirvez Media Center, you grant us a limited license to store, process, and display Your Content solely to provide the Service to you.

5.2 Our Service

Sirvez and its original content, features, and functionality are owned by Sirvez and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

5.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

6. Storage and Data Management

6.1 Storage Limits

Sirvez Media Center may impose storage limits on your account. We reserve the right to modify storage limits at any time with reasonable notice.

6.2 Data Backup

While we implement backup procedures, you are responsible for maintaining your own backups of important recordings. We are not liable for any loss or corruption of Your Content.

6.3 Content Removal

We reserve the right to remove or disable access to any content that violates these Terms or applicable law, without prior notice.

7. Subscription and Payments

Certain features of Sirvez may require payment of fees. If you purchase a subscription:

• You agree to pay all applicable fees as described at the time of purchase
• Subscriptions automatically renew unless cancelled before the renewal date
• Fees are non-refundable except as required by law
• We may change fees with 30 days' notice
• You are responsible for all taxes associated with your purchase

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Service will be uninterrupted, secure, or error-free
• That defects will be corrected
• That the Service is free of viruses or harmful components
• The accuracy, reliability, or completeness of any content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIRVEZ SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss or corruption of recordings or content
• Your violation of recording consent laws or third-party rights
• Damages arising from your use or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sirvez and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) your violation of recording consent or privacy laws.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. You may terminate your account at any time by uninstalling the extension and deleting your account. Upon termination, your right to use the Service will immediately cease, and we may delete Your Content from our servers after a reasonable grace period.

12. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. You acknowledge and agree that we shall not be liable for any damages arising from your use of third-party services.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

14. Governing Law and Dispute Resolution
